المرأة في قوانين الميراث في مصر القديمة

تميزت المرأة في مصر القديمة عن أقرانها في الحضارات القديمة الأخرى أنها کانت ندا قويا للرجل أمام القانون؛ استطاعت أن تقف بنفسها أمام الهيئات القانونية المختلفة للتقاضي وإبرام العقود والوصايا، کما أنها تمتعت بالاستقلالية القانونية عن زوجها. کذلک امتلکت جميع أنواع الممتلکات الثابت منها والمنقول، وامتلکت الحق الکامل في التصرف فيها. ستبرز هذه الورقة البحثية دورها في جزئية معينة من القانون، أي في عملية التوريث. أبرزت الوثائق القانونية والأدبية أن المرأة عملت کمورثة لأطفالها منذ عهد الأسرة الثالثة، وظهرت مورثة لأفراد من خارج أسرتها في الأسرة الحديثة. أظهرت الوثائق کذلک أن الأنثى ورثت حصة مساوية للذکر، لکن سبقها هو في اختيار حصته أولا. استطاعت أن ترث في الثابت والمنقول من الممتلکات. عملت الزوجة کذلک واصية على اطفالها القاصرين. والبنت الکبرى امتلکت الحق في إدارة الأملاک نيابة عن إخوتها الصغار سواء أکانوا ذکورا أو إناثا. کما أن الإناث في مصر القديمة استطعن أن يدلين بشهادتهن في حالات النزاع بشأن الميراث، واستطعن کذلک أن يکتبن أسمائهن في قوائم الشهود على وثائق التوريث. ومن ناحية أخرى أفادت هذه الدراسة أن المرأة التي سقطت تحت العبودية صارت جزءًا من الأملاک الموروثة.
